Murder, parricide raps up vs Tan brothers
The Court finally has jurisdiction on the celebrated massacre of Filipino-Chinese businessman, his wife and 6 year-old daughter, almost nine months into the grissly killing.
This, as information for two counts of murder and parricide charges were filed and raffled off yesterday (Tuesday) to Branch 32 of the 6th Regional Trial Court (RTC) here.
Said development sealed off the long wait for the resolution of the case with the earlier delay then caused by legal remedies availed of the Defense panel.
The government moved to push for the prosecution of brothers Archie and Jan Michael Tan tagged as assailants and attackers of their parents, couple Francisco Bobby Tan, wife Cindy Zayco and the suspects' half-sister Katherine.
In a 23 paged-Resolution obtained by The News Today (TNT), Investigating Prosecutor Jeremy Bionat submitted to Court that probable cause was sufficiently established against Archie and Jan Michael.
Both, the Resolution stated, conspired and confederated in the stabbing to death their stepmother and stepsister and did the same in stabbing to death their father Bobby.
To recall, delay was met with the duo's counsel seeking for a parallel probe from the National Bureau of Investigation (NBI).
The bureau's findings came out synonymous to what the Criminal Investigation and Detection Group (CIDG) had submitted before government prosecutors. .
"That is fine. Let them avail and enjoy all the due process that they can have and let them exhaust all remedies. After all, we are confident that truth and justice will ultimately prevail and those responsible in the senseless killings will pay for their dastardly crime," lawyer Cornelio Panes, co-counsel for the Zayco family then said in a The News Today (TNT) interview."They wanted the NBI not trusting the CIDG's findings then so be it. It is just a matter of time when the preliminary investigation will finally take place and we are ready for it. We stand by the CIDG," he added.
Reached for reaction yesterday, Panes said his camp is certainly ecstatic over the latest development while adding, "yes, it was a long wait but now the wait is over and it was very well worth it."
Radio reports then disclosed how Chief City Prosecutor Efrain Baldago and Assistant Prosecutor Jeremy Bionat were purportedly constrained to make any moves pending the clearance or direct order from Justice Secretary Raul Gonzalez.
With the case and yet latest legal battle set to commence, surviving children of Bobby and Cindy remains in the maternal side, Zayco family who has full custody of all five siblings.
