DOJ uphelds parricide, double murder raps vs Tan bros.
Prosecution team of the celebrated Tan massacre scored yet another victory while brothers Archie and Jan Michael Tan, prime suspects in the violent deaths of their father, stepmom and younger sister lost yet another legal battle in an appeal of the cases against them before the Department of Justice (DOJ).
This, as no less than DOJ Secretary Raul Gonzalez Sr. dismissed the Petition for Review sought by the Iloilo City Prosecutor's Office on an earlier Resolution that found probable cause to charge the duo with parricide and double murder.
Citing Section 12 (c) of DOJ Department Circular 70, Secretary Gonzalez in handing down the Resolution stated that “after having carefully examined the records, we found no such errors committed by the prosecution.”
As such, no reversal was made and instead, the parricide and double murder raps as docketed in Information Sheet (IS) No. 086-06 will stand.
Principal complainants on the case is the Criminal Investigation and Detection Group (CIDG) led by Police Superintendent Renato Gumban.
The team of private lawyers for the prosecution include noted criminal lawyer, Cornelio Panes.
To recall, the prosecution in its comment before the DOJ submitted a 58-paged counter-argument that further established a timeline of the crime that led to the prosecution's position that brothers Archie and Jan Michael were responsible of the grisly killings.
Now on its 14th month since the celebrated deaths occurred, bereaved family members from both sides continue to await for justice.
Filipino-Chinese businessman Francisco “Bobby” Tan, his wife Cindy Zayco and six year-old daughter Katherine were brutally murdered inside the family mansion in Molo, Iloilo City. No arrests had been made with Archie and Jan Michael able to avail of all legal remedies.
