Ex-GSO head files writ of execution for his restoration
BACOLOD CITY -- Former General Services Officer (GSO) Jerome Solinap confirmed yesterday that he filed a petition for the issuance of the writ of execution after the Court of Appeals Special Twentieth Division rendered a ruling last July 28, 2008 directing Mayor Evelio Leonardia to restore him to his former position as General Service Officer and ordering also the city government to pay all his salaries, allowances and benefits pertaining to him including those previously withheld.
Solinap said that the city government had not yet restored him to his former position despite the court order but he will be automatically restored once the writ of execution is granted.
Meanwhile, City Legal Officer Atty. Allan Zamora has filed a Motion for Reconsideration in behalf of Mayor Evelio Leonardia setting aside such judgment citing his legal ground on the extension of the reassignment of former GSO head beyond one year.
As stated in the Motion, "It is therefore; very clear that private respondent as General Service Officer of the City of Bacolod is the custodian and is accountable for all properties of the City of Bacolod, both real and personal. When the continued reassignment of private respondent to the Office of the City Mayor was directed purposely for him to prepare a complete inventory of all properties of the City of Bacolod, such continued reassignment of private respondent was consistent and in consonance with his function and responsibilities as such General Services Officer." Atty Zamora further stressed in his motion that the City Mayor has all the right to extend the reassignment of Solinap beyond the one year period.
On the other hand, Solinap insisted that what the mayor did is a clear diminution because his position is equivalent to a Department Head and that he cannot be reassigned to the City Mayor's Office for inventory because he had personnel under him to perform such task.
Solinap said that he continued reporting to his office although his salaries were withheld. He is now on leave and awaiting the issuance of the writ of execution from the CA Special Twentieth Division.
