DOJ clears Ivisan dad, 3 others in hazing case
ROXAS CITY – The Department of Justice (DOJ) has exonerated a member of the Sangguniang Bayan (SB) of Ivisan and three others while the host of the fraternity hazing was included in the case in violation of Republic Act 8049 or Anti-Hazing Act in Relation to Art 249 of Revised Penal Code or Homicide.
In a 16-page resolution penned by DOJ Sec. Raul Gonzalez, Sr., dated May 27, 2009, cleared were: SB Member Christian Sander Mendoza, Archie Durana, Engr. Roque Isiderio, and Dinkee Mandar.
Added as respondent of the case was Christy Dyna Baldesimo Honrado, hostess of the hazing while the DOJ retained Phel Ralf Patricio, Edeneo Machado, Ramir Bula and Dexter Alvarez as respondents bringing the total of five respondents of the case.
Last July 4, 2007, the provincial prosecutor find a prima facie evidence against Honrado, Bula, Mandar, Alvarez, Patricio, Machado and Duran, however, on October 19, 2007, Honrado was exonerated while Mendoza and Isiderio were also added as respondents of the case by Assistant Prosecutor Gotico.
Due to the result, the respondents and Mr. Jesus Dollete, father of hazing victim, filed a petition for review before the DOJ.
In the DOJ review, Honrado failed to convince the higher court that as hostess for hazing, she has no knowledge of what happened during the incident since she was sleeping with her husband.
Meanwhile, Mendoza, Durana and Mandar were cleared and exonerated by the DOJ to be included in the hazing case since they were applicants and neophytes of the fraternity and were proven to have no participation in the initiation.
Meanwhile, Isiderio was also cleared since he was the one who prevented the bodily harm against the victim by calling the attention of Honrado as hostess that physical contact directed to the Pledgee is in violation of the fraternity standard.
Last January 15, Mambusao Regional Trial Court (RTC) Judge Daniel Antonio Gerardo Amular issued the warrant of arrest against eights suspects who are officers and members of Alpha Phi Omega (APO) Fraternity and Sorority involved in the initiation rites that resulted to the death of John Angelo Dollete last May 6, 2006 in Sapian, Capiz
Subjects for arrest warrant are: Demo Machado of RCL Marketing, Kalibo Branch, Kalibo, Aklan; Sangguniang Bayan Member Christian Sander Mendoza of Ivisan, Capiz; Archie Durana of Salgan, Maayon, Capiz; Rhel Reff Patricio of President Roxas, Capiz; Dinkee Mandar of Punta Tabuc, Roxas City; Dexter Alvarez and Ramer Bula of Brgy. Loctugan, Roxas City; and Engr. Roque Isiderio of Consolacion, Mambusao, Capiz.
No bailbond was recommended for the accused as the suspect went in hiding and became at large.
To recall, Dollete, a fifth year engineering student at Capiz State University (CapSU) was declared dead on arrival by attending physician at the Mambusao District Hospital when he was brought by members of the APO at dawn on May 6, 2006.
Dollete, died on the spot, when he was mauled and paddled by members of the said fraternity.
Meanwhile, Coast Guard Officer Jesus Dollete, father of the victim, said that he is happy to know that some of the suspects were included but sad since four of them were cleared by the DOJ.
