SP has no jurisdiction over large-scale mining -- Lastimoso
ROXAS CITY – The Sangguniang Panlalawigan (SP) has no jurisdiction over large-scale mining and it could only regulate small-scale mining activities.
This was the findings of Board Member Rommel Lastimoso based on the study conducted by his committee in relation to the passing of SP Ordinance No. 001 series of 2002, an ordinance granting 15-50 years moratorium for the large-scale mining operation in Capiz.
Lastimoso said it is the national government that has jurisdiction over large-scale mining.
However, another Resolution No. 069 was also approved allowing mining companies to conduct mining exploration in Capiz. The said resolution was approved June 12, 2007.
Lastimoso, chair of committee on environment and national resources, said that the provincial government will have to draft regulation for small-scale mining in Capiz.
It was learned that under the Mining Act, the national government is openly allowing mining companies to conduct mining operations in the whole Philippines provided it has acceptance from the locality.
Board Member Gilbert Ardivilla who is vocal in opposing the mining exploration in Capiz even hit his colleagues during the committee hearing held last Friday at the session hall at the provincial capitol.
The committee hearing was also attended by Board Members Fritz Cruz-am, Baden Cantiller, David Bauson, Nenita Martilino, Ricky Martin, Alfonso Bediones, Jr., Esteban "Nonoy" Contreras, Atty, Jose Villanueva, and Engr. Marlon Bonete of the Department of Environment and Natural Resources among others.
