AFP, PNP checkpoints this election period lawful
Two types of checkpoints may be lawfully established this election period. These are: (1) checkpoint set up by the Armed Forces of the Philippines in line with its Internal Security Operations (ISO) and (2) checkpoint established by combined elements of the AFP, PNP and Commission on Elections (Comelec) to achieve unity of efforts and mutual security.
Chief Supt. Wilfredo Dulay Sr. said that in either case, checkpoints can work both ways. On the one hand, ISO checkpoint of the AFP can also be a Comelec checkpoint for the enforcement of Comelec gun ban and as deterrent against Private Armed Groups. On the other hand, Comelec checkpoint can be used as an ISO checkpoint for the purpose of movement control against the rebels and other threat groups.
Dulay further explained that the additional difference between a Comelec checkpoint and ISO checkpoint is that the former has a signboard pursuant to Comelec Resolution No. 7763, while the latter does not have. He, however, advised motorists to immediately report to the nearest police station the presence of suspicious checkpoints being set up in the area.
"We cannot discount the possibility that the elements of the New People's Army or any criminal group may perpetrate their nefarious activities in disguise of checkpoint operations. Several incidents had happened in the past and this may happen also this election," the Dulay further said, adding "though not deputized by the Comelec, our AFP counterparts can still support us in our campaign for a peaceful and orderly election, particularly in preventing the movements of rebels and other criminal elements through the conduct of checkpoints."
