Court stops PPA's attempt to revoke Bredco permit
BACOLOD CITY -- The Bacolod Real Estate Development Corporation (Bredco)has been allowed by Branch 42 of the Regional Trial Court to continue operations after its permit was revoked by the Philippine Ports Authority (PPA) recently.
Judge Fernando Elumba granted the writ of preliminary injunction filed by Bredco, citing lack of due process when its permit was revoked by PPA in June of 2007.
In his decision released this Tuesday, Judge Elumba cited that the abrupt revocation of Bredco/s permit and registration "results to an irreparable injury to the plaintiff, taking into account its debts and obligations to its creditors, its employees, who will suffer economic dislocation, and to the Government of the City of Bacolod."
The PPA canceled Bredco's Certificate of Registration and Permit to Operate (CRO/PTO) Nos. 330 and 330-A due to alleged unauthorized collection of tariff fees.
Likewise, PPA was ordered to cease and desist from charging 100 percent usage and wharfage fees on all vessels and cargoes loaded and unloaded within Bredco's area of operation and 10 percent stevedoring and arrastre fees.
The court also ordered plaintiff to pay a P1-million bond in to the P3 million that was already deposited by Bredco.
