Court junks TRO vs poultry farm closure
ROXAS CITY – Regional Trial Court (RTC) Presiding Judge Ignacio Alajar denied the petition for temporary restraining order (TRO) filed by Ex-Mayor Rodel Obordo against Sapian Mayor Arturo Orosco, Sr., Ph.D. relative to the closure of Obordo's poultry farm in Brgy. Maninang, Sapian.
Documents obtained by The News Today revealed that Orosco ordered the closure of Obordo's poultry farm due to five violations, namely: 1) operating without business permit; 2) operating without a building permit; 3) violating the provision of Section 8 (8.6.7) (A.B.C.) of P.D. 856 of the Department of Health otherwise known as the Code of Sanitation of the Philippines; 4) violation of Section 9 (9.1) of the same code and; 5) violation of Section 8(G) of the Article IV of the municipal Ordinance No. 4 series of 2005.
Obordo on his part refuted that his formal request for renewal of sanitary permit was disapproved by Dr. Alfonso Orosco adding that with the approval, there is definitely no way for him to comply with item no.1. "I do believe all other items in this letter are totally inapplicable to me," Obordo said in his 13-page complaint. Obordo is assisted by his lawyer Lorencito B. Diaz.
Obordo accused Orosco of political persecution saying the latter wanted to cripple him financially so he could have no fight with him in the next election.
Orosco, however, vehementaly denied that the closure of Obordo's poultry farm is politically motivated. He said that he only acted on the complaints of 21 petitioners who are affected by the foul coming from Obordo's poultry farm.
The mayor said that he even bought chicken manures from the poultry farm to help in the reduction of the foul odor.
"I have done a win-win solution for Obordo's case since I'm the one who buy chicken manures so that it can not produce poul odor," Orosco said.
Also named as respondents in the civil case is the Sanggunian Bayan of Sapian represented by its presiding officer Vice Mayor Ralp C. Odrunia.
