Leonardia restores Solinap as GSO head
BACOLOD CITY -- Mayor Evelio Leonardia has issued a memorandum restoring Jerome Solinap as head of General Services Office (GSO).
City Legal Officer Atty. Allan Zamora confirmed the order from the mayor pursuant to the latest resolution from the Court of Appeals (CA), restoring Solinap to his previous position.
The city is now on the process of preparing a motion for reconsideration to the Supreme Court but pending the said appeal Solinap should be back as GSO head, Zamora said.
"The mayor should submit the appeal to the highest tribunal on or before November 8, 2008," Zamora added.
The Court of Appeals issued a Writ of Execution to Leonardia who received it on Oct. 24, 2008.
The Writ of Execution was issued by the Court of Appeals upon the request of Solinap. It was signed by Associate Justices Amy Lavaro-Javier, Priscilla Baltazar-Padilla and Franchito Diamante promulgated on Oct. 14, 2008.
The Court of Appeals denied with finality the motion for reconsideration filed by Leonardia asking that Civil Service Commission Resolutions 070055 and 070660 be reconsidered and set aside.
It also directed that Solinap be paid all salaries, allowances and benefits pertaining to him including all those previously withheld.
Solinap's salaries and other benefits have been lodged in his name by the City Accountant under the accounts payable of the city.
In Resolution 070055 dated Jan. 9, 2007 the CSC nullified Solinap's continued reassignment to the City Administrator's Office and directed the mayor to restore him to his post at the GSO. While the CSC denied Leonardia's motion for reconsideration in CSC Resolution 070660 dated Apr. 11, 2007.
Leonardia had assigned Solinap to City Mayor's Office on July 28, 2004 to handle the inventory of all the properties of the city and submit a report on the matter. Solinap was later assigned to the City Administrator's Office to assist the City Administrator on concerns affecting the markets and other socio-economic units.
The mayor also said that there was no diminution in Solinap's rank since the preparation of the inventory report was part of his tasks as GSO officer though he was relieved of his functions so he could focus on making the inventory.
