BIR warns business owners vs 'Oplan Kandado'
BACOLOD CITY – Bureau of Internal Revenue (BIR) Revenue Region 12 director Rodita Galanto warned business establishments here of closure once they fail to issue receipts for the goods they sell or services they render.
The warning is in line with the directive issued by BIR Commissioner Sixto Esquivias IV to enforce "Oplan Kandado".
Revenue Memorandum Order No. 3-2009 covers all establishments not complying with the essential requirements such as issuance of receipts, filing of returns, declaration of taxable transactions, taxpayer registration and the paying of the correct amount of taxes.
It also requires the BIR personnel to conduct covert, overt, and short duration surveillances.
"The BIR will be conducting surveillance operations, including close watch on establishments for 15 days to get their average taxable income," the memorandum stated.
Galanto, however, admitted that at present they lack personnel to conduct monitoring and inspections.
Meanwhile, with the signing into law of the Philippine Cooperative Code of 2008, Galanto said the BIR will continue to enforce its current policy.
Until there is no guideline released, they have still legal basis to collect the advance Value Added Tax of sugar cooperatives' refined sugar.
Last year, it has become an issue in the entire province when the sugar cooperatives questioned the collection made by the bureau that led to the filing of charges to the proper court which until now are pending resolution.
Galanto justified during that time that sugar cooperatives shall submit their list of buyers so that they can look into the records whether they are exempted or not.
Galanto found out that there were collections made by the cooperatives to the traders but not remitted to the government coffers.
