City to pay P2.3M bulldozer rental
BACOLOD CITY — The Sangguniang Panlungsod of Bacolod City ratified last Wednesday the compromise agreement entered into by the city government of Bacolod and Vicente H. Villarosa relative to the Civil Case No 09-13413 for “Sum of money and damages” docketed as SP Correspondence No. 09-1161, subject to the condition that the same is not contrary to laws, morals and public policy as determined by the Honorable Court.
The said compromise agreement was done when the plaintiff Vicente H Villarosa, doing business under the name of VJ Repair, Construction and Supplies, proposed to the City of Bacolod that he is willing to accept payment for the use and rentals of his bulldozer, covering the period from April 1, 2008 to December 31, 2008 at the Bacolod City Felisa Dump Site, in the total amount of P3,275,625, representing 2,183.75 hours at an equivalent rate of P1,500.00 per hour.
The City of Bacolod likewise agrees to pay Villarosa the said amount representing the use and rentals of said bulldozer.
On the other hand, SP Member Wilson Gamboa Jr. casts doubts on the proposed compromise agreement since there was no lease contract presented during the session last Wednesday. Gamboa said that he did not question the legality of the compromise agreement before the court but he simply asked the production of the lease contract as basis for the ratification of the compromise agreement. He believed that all lease contracts must first pass the council before its approval.
