Makati court grants TRO vs P683M loan?
ROXAS CITY – Four prominent Capiceños in Manila were able to secure a temporary restraining order (TRO) stoppin the Philippines Veterans Bank (PVB) from releasing the P683-million proposed loan of the Capiz provincial government.
Report reached The News Today (TNT) that the said the TRO was good for 72 hours. It was issued by the Regional Trial Court (RTC) of Makati City and was served to PVB’s main office there on February 10.
The petitioners, who are also successful businessmen in Manila, are lawyers Florencio Martinez and Ceferino Alba, former Assemblyman Charles Escolin and Ambassador Frank Alba.
It was learned that there is an existing civil case filed by Board Member Gilbert Ardivilla in the local court here to stop the provincial government under Gov. Victor Tanco from signing or executing any commercial document pertaining to the P683,160,000 loan transaction with the PVB.
Ardivilla, who is a lone oppositor of the loan, claimed it was “railroaded and haphazardly passed through tyranny of numbers.”
In a text message received by TNT believed to be coming from somebody from Ugyon Kita Capiz (UKC) it was said that there was no forum shopping on the issuance of the TRO, considering that a similar case was also filed by Board Member Gilbert Ardivilla which is presently pending at the RTC Branch 19 in Roxas City.
The same text also revealed that it’s the right of Capiceños to file a taxpayers’ suit against the alleged bad loan of the provincial government.
The TRO, which was already served at the provincial capitol last week, will be heard today at RTC Makati City.
