Mabilog revokes P130-M Pavia housing project deal
The Iloilo City Government has revoked the contract of Ace Builder and Enterprise, contractor of the abandoned P130-million housing project for city government employees in Pavia town.
Mayor Jed Patrick Mabilog said he signed on Monday the notice of termination of contract addressed to Alexander R. Trinidad, proprietor of ABE.
He said City Legal Office chief Jose Junio Jacela will lead a team of lawyers who will deliver the notice to Trinidad in his office in Pasig City today.
“Effective termination, a joint inventory and evaluation of the project will be conducted by the City Government pursuant to the rules and regulations governing the implementation of infrastructure project in Iloilo City,” Mabilog said.
In the notice, the mayor told Trinidad: “Your company and that of your sureties are hereby enjoined to participate on or before Oct. 10, 2010. Please take note that failure to appear shall be deemed a waiver of whatever rights you have under the contract.”
Mabilog proceeded to terminate the ABE contract after the City Council passed a resolution authorizing him to cancel and rescind such agreement effective 30 days after he receives the authority.
The ABE contract is being revoked on the grounds of “substantial defects in workmanships and use of substandard materials in the partially completed units such as but not limited to roofing sheets, ceiling board and reinforcement steel bars.”
The contractor’s shortcomings are contained in the “Summary of Cost of Report on Finding of Substandard Materials and Report of Defects, Deficiencies and Discrepancies as of June 30, 2003 issued by the Office of the City Engineer and Commission on Audit Evaluation Report dated Nov. 16, 2005.”
Other violations include “non-compliance with the plan and deviations of actual work from the approved plans and specifications such as unauthorized use of the unprescribed fascia board.”
The ABE also committed “unreasonable suspension of work and failure, refusal and neglect to supply and provide the required tools, materials, supplies, equipments, and facilities to complete the project since 2003 despite repeated demands and representation from the City Government.”
Moreover, there was also an “unjustified abandonment of the housing project without providing adequate security resulting in the stealing and loss of materials and dilapidation and depreciation of partially built units.”*
