Tied candidates to draw lots Saturday
The Commission on Elections in Iloilo City is coming up with a list of tied candidates who will participate in the drawing of lots on Saturday.
Assistant City Election Officer Jonathan Sayno said two pieces of paper will be used, one bearing the number 1 and the other, 2.
For village chiefs, whoever will get number 1 will be declared winner while for councilman, the one who will pick number 2 will occupy the higher rank.
In case the tied candidates were not around after the canvassing, the Barangay Board of Canvassers in-charge of the particular precinct will send a notice to convene to both candidates to do the draw lots, five days after the elections.
Sayno said the official notice to both candidates should be personally received by the candidates, not through phone call or text message.
If one of the tied candidates fails to arrive at the convening area, he or she will be declared in default.
Section 240 of Batas Pambansa Bilang 881, otherwise known as the Omnibus Election Code, provides for the drawing of lots in case of a tie of two or more electoral candidates garnering the same or equal highest number of votes, with the proclamation as winner of the candidate favored by luck.
The newly elected barangay and Sangguniang Kabataan officials will assume office on November 30.
Incumbent members of the barangay council, including the village chief and councilmen, who lost in their reelection bids, will stay in their office until noontime of the said date.
Election Regional Director Dennis Ausan said the proclamation of winning candidates who face petitions will go on unless there is a motion or notice suspending the proclamation.
“Filed disqualification petition questioning the residency or citizenship (of a candidate), cannot stop the proclamation unless there is an order by the Commission en banc,” he said.
In case the winning candidate exceeds on his/her three-year term and there is a resolution suspending his/her proclamation, the proclamation shall be postponed or suspended for further investigation and hearings regarding the allegation.*
