SEC sets aside Revocation Orders on resto, Leganes drivers' group
Continued legal existence of one popular Ilonggo-run restaurant and catering service alongside an Ilonggo transport group has been assured. This, after the Securities and Exchange Commission (SEC) resolved to set aside an earlier Revocation Order issued on the two.
In a public advisory, SEC disclosed recent orders giving anew the go-signal for Casa Ilongga operations and the Leganes Operators and Drivers Association, Incorporated.
To note, an Order for Revocation was issued against Casa Ilongga in September 2003 followed in November by the revocation of its Certificate of Registration. The SEC in its Order justified its Orders due to "non-compliance with the Commission's reportorial requirements…"
Three grounds including a reason that "it has established goodwill over the years" were presented by Casa Ilongga management in seeking for reconsideration. Further still, it submitted documents to back up its claim of continued operation such as Tourism Licenses, Mayor's Permits and Income Tax Returns filed over the years.
Highlighting its SEC appeal was Casa Ilongga's statement that it never intended to violate the law and is now committed to comply with SEC rules.
Further still, Casa Ilongga was ordered to submit its latest Mayor's Permit with failure to comply a stated ground for recall of the SEC reconsideration.
A decision was then reached to grant the Petition and set aside the Revocation Order contained in SEC En Banc Case No. 09-07-0214. The Decision was penned by SEC Commissioners Ma. Juanita Cueto, Raul Palabrica and Jesus Enrique Martinez and SEC Chairman Fe Barin.
Meantime, a letter from City Councilor Armand Parcon served as among the saving factors for the Leganes Operators and Drivers Association Incorporated.
The transport group likewise petitioned the SEC for reconsideration on an earlier Revocation Order issued. Councilor Parcon's letter inviting the association to a committee apparently gave credence on the legal existence of the group. Parcon used to be the head of the Iloilo City Council's Committee on Transportation.
Contained in SEC En Banc Case No. 03-07-003, unanimous decision was reached to set aside the Revocation Order signed by SEC Chair Barin and four SEC commissioners.
